PARTICIPATION AGREEMENT AND INFLATABLES RELEASE OF LIABILITY, WAIVER OF CLAIMS, EXPRESS ASSUMPTION OF RISK AND INDEMNITY AGREEMENT (collectively, the “AGREEMENTS’”)

Express Assumption of Risk Associated with use of Inflatables

Your school (“SCHOOL”) and JM1 Ventures LLC doing business as STEP IT UP! ARIZONA (“STEP IT UP!”) have entered into an agreement to coordinate a school fundraiser which may include, but not be limited to, a kick-off event, receipt of prizes and a Day of Awesomeness, including outdoor activities with inflatables, DJ music and dancing and ball throwing/kicking stations (collectively, the “Events”).

In most instances, Participant is a minor so therefore these AGREEMENTS will be acknowledged and agreed to by a parent or guardian on behalf of Participant and Participant’s heirs, executors, administrators and anyone else entitled to act on behalf of Participant.

Regardless of the safety measures, warnings and care taken to avoid injuries and/or illness and property damage, there are inherent hazards and risks associated with the Events, including, but not limited to, personal injury, sickness and fatality, which may be caused by, without limitation, falls, weather related conditions (including wind and heat or sun related injuries or illnesses like sunburn, sun stroke or dehydration), presence of insects and flying life forms, equipment and/or prize malfunction or misuse, fatigue and contact with other participants.

In consideration of my child being allowed to participate in the Events, as well as the use of any of the associated inflatables and prizes, I hereby agree that Participant is physically/mentally capable of participating in the Events and I agree to assume all risks associated with participation in the Events. I also hereby waive and release, to the full extent permitted by law, STEP IT UP!, its suppliers, vendors, agents and independent contractors and each of their employees, officers, directors, members, agents, volunteers, representatives and successors (collectively, “STEP IT UP! REPRESENTATIVES”) from all claims, demands, actions, causes of action and liabilities of any kind arising out of Participant’s participation in any of the Events and ownership of the prizes, whether caused by active or passive negligence of STEP IT UP! REPRESENTATIVES. By executing this document, I agree to hold the STEP IT UP! REPRESENTATIVES harmless and indemnify them in conjunction with any injury, property damage or loss of life that may occur as a result of participation in the Events and ownership of the prizes, and I am releasing claims and giving up substantial rights, including any right to sue.

I specifically waive any defense insofar as these Agreements are concerned that may arise as a result of any law and/or regulation or policy that may impact any enforceability or validity of these Agreements. By entering into these Agreements, I am not relying on any oral or written representations or statements made by the STEP IT UP! REPRESENTATIVES other than what is set forth in these Agreements.

I declare that I am of legal age and am competent to review these Agreements on behalf of the Participant and I have read these Agreements, understand them, and I agree to be bound by them.
